General Terms & Conditions
Last updated 14-10-2026
On ordering a photovoltaic system, a battery energy storage system or related services, a contract is concluded exclusively with Lumenkraft, a proprietary concern, No. 20, Thiruppur Kumaran Street, New Perungalathur, Chennai — 600063, Tamil Nadu, India (GSTIN 33AUCPS9276L1ZY, UDYAM-TN-02-0431942) ("Lumenkraft").
These terms apply together with the quotation accepted by the customer and, where one is signed, the Consumer–Vendor Agreement. Where the signed quotation or agreement provides otherwise, it prevails over these terms.
1. Scope
All services, supplies and offers of Lumenkraft are made exclusively on the basis of these terms. Conflicting or different terms of the customer are not recognised unless Lumenkraft has agreed to them in writing.
2. Offers and yield estimates
Offers in brochures, advertisements, on the website and similar are non-binding and subject to change; this also applies to prices.
Sample yield, savings and payback calculations are forecasts based on irradiance data and technical design software. Actual generation may deviate by up to 15% because of external influences such as weather, shading, soiling, grid availability and tariff changes. Government subsidies (e.g. PM Surya Ghar) are granted and paid by the authorities; Lumenkraft assists with the application but does not guarantee their amount or approval.
3. Terms of payment
Unless the accepted quotation sets out a different payment schedule, the following are due: 50% of the contract value within 7 days of signing the order; 45% within 7 days of Lumenkraft announcing the delivery of the material, and in any case before delivery; and 5% after installation, commissioning and handover. Other terms of payment require Lumenkraft's express written consent.
A payment is on time when it is credited to Lumenkraft's bank account. If a payment is late, Lumenkraft will send a reminder. Overdue amounts carry interest as permitted by law — for business customers as provided by Sections 15 and 16 of the MSMED Act, 2006.
The customer bears the additional costs caused by late payment, such as postponed deliveries and the re-scheduling of material and crews.
4. Prices
Agreed prices are binding for 10 days from the date of the order. After that, the price list valid at the time of delivery applies. If prices have risen by more than the Consumer Price Index (CPI) published by the Government of India over the same period, the customer may cancel the contract without liability for damages.
Unless the quotation states otherwise, prices are exclusive of GST; GST is shown separately on the invoice at the rate in force at the time of supply.
5. Conclusion of contract
Purchase and installation contracts become binding only on Lumenkraft's written acceptance (an order confirmation, which may be sent by e-mail).
6. Changes
Changes requested by the customer after the order become part of the contract only when Lumenkraft confirms them in writing.
7. Customer's information
The customer is responsible for the accuracy of the information provided, in particular on the structural capacity of the roof or site, and of the building plans, floor plans and drawings submitted. Additional costs or hazards arising from incorrect information are borne by the customer, unless Lumenkraft knew of the error or failed to recognise it through gross negligence. The structural adequacy of the roof or building is in principle to be verified by the customer.
8. Retention of title
Material supplied remains the property of Lumenkraft until paid for in full, unless the law provides for an earlier transfer of title. If it is processed, combined or mixed with items not belonging to Lumenkraft, Lumenkraft acquires co-ownership of the new item in the ratio of its invoice value to the other items used. The customer keeps Lumenkraft's property safe free of charge. If third parties seek to seize Lumenkraft's property, the customer shall point out Lumenkraft's ownership and inform Lumenkraft without delay.
9. Lightning protection and earthing
External lightning protection is part of the supply or installation only where it is listed in the quotation. Lumenkraft always installs earthing and equipotential bonding when erecting a PV system.
10. Self-installation
Where the customer installs the system, accessories are supplied in sufficient quantity. Surplus material must be returned; the customer does not acquire ownership of it, even after full payment. Free additional deliveries are made only if the layout plan has been followed.
11. Delivery
Changes to the delivery date and the scope of delivery caused by the non-availability of goods at the upstream supplier, and changes to products by the manufacturer, remain reserved. A substituted product shall be of equal or better specification.
12. Civil work
Trenching and cable runs longer than 2 m on the customer's premises are to be carried out by the customer or agreed separately.
13. Warranty
The products installed under the contract carry the respective manufacturer's warranty for equipment, function, efficiency and service life according to the manufacturer's terms; Lumenkraft hands over the warranty certificates and enforces them for the customer. In addition, the customer's statutory rights apply.
Lumenkraft warrants its installation workmanship for 2 years from commissioning, or for the longer period stated in the quotation or the signed Consumer–Vendor Agreement (5 years for rooftop systems under PM Surya Ghar).
In case of self-installation, the customer may not process or install parts complained of as defective where the defect can be recognised before installation. If the customer finds damaged parts during installation, the installation must be stopped at once. The customer shall make the defective parts available to Lumenkraft for repair or replacement. Lumenkraft is not liable for defects in parts or in the fitness for use of the system caused by faulty installation by the customer or by third parties not engaged through Lumenkraft.
14. Cancellation by the customer
The customer's right to cancel within the cancellation period is set out in the Cancellation & Refund Policy. If the customer withdraws from the contract after that without legal justification, Lumenkraft may claim compensation for non-performance. Lumenkraft may then claim 25% of the agreed contract value as a reasonable pre-estimate of its loss, without having to prove the loss, and without prejudice to claiming a higher proven loss. The customer may prove that a lower loss has occurred, in which case the compensation is reduced accordingly.
15. Applicable law
The contract is governed exclusively by the laws of India. The customer's rights under the Consumer Protection Act, 2019 remain unaffected.
16. Jurisdiction
Where the customer is a business, the courts at Chennai, Tamil Nadu have exclusive jurisdiction. Otherwise, the statutory jurisdiction applies, including that of the Consumer Disputes Redressal Commissions.
17. Severability
If individual provisions of these terms are invalid, the validity of the remaining provisions and agreements is not affected.
18. Grievances
Complaints and grievances can be addressed to the Grievance Officer, Lumenkraft, at info@lumenkraft.in or +91 98410 05760, or by post to the address above. We acknowledge a complaint within 48 hours and aim to resolve it within one month.
